ICJ Ruling Sparks Air Strikes in Gaza’s Rafah Camp

Minutes after the International Court of Justice (ICJ) issued a ruling calling for a halt to Israel’s offensive in Rafah, Israeli warplanes launched a series of air strikes on the Shaboura camp in the center of Rafah. Local activists reported terrifying bombing sounds and black smoke clouds over the Shaboura camp, with rescue teams unable to reach the site due to the intensity of the strikes.

Israeli government spokesperson David Mencer stated, “There is no power in the world that will push us to commit a public suicide, because that’s what this is, to stop our war against Hamas.” Israeli cabinet ministers are scheduled to meet later to discuss the ruling, but officials have previously asserted that no external force will deter Israel from protecting its citizens and pursuing Hamas in Gaza.

The Palestinian Authority (PA) and Hamas have welcomed the ICJ decision. However, Hamas insists that the call to end the offensive should apply to all of Gaza, not just Rafah. PA presidential spokesperson Nabil Abu Rudeina remarked that the ruling “represents an international consensus to end the war on the Gaza Strip.”

South Africa, which petitioned the ICJ to halt Israel’s offensive in Rafah as an emergency measure, argued that Israel’s actions in southern Gaza amount to a “genocidal” operation threatening the survival of the Palestinian people. South African Foreign Minister Naledi Pandor described the ruling as a “very clear call for a cessation,” noting its strong wording and provisional measures.

This is the first time the ICJ has issued a ruling compelling Israel to significantly alter its military operations in Gaza. The panel of judges determined that Israel had not sufficiently demonstrated that its evacuation efforts and related measures were adequate to mitigate the immense risk faced by the Palestinian population in Rafah.

The case, brought by South Africa under the 1948 genocide convention, argued for the protection of Palestinians under international law. The ICJ’s order acts as an injunction to prevent further deterioration of the situation in Gaza, pending a more detailed examination of the case’s merits.
