Commission Formed to Probe Judicial Interference by Spy Agencies

The decision to constitute the commission comes in response to a letter penned by six IHC judges to the Supreme Judicial Council (SJC), urging a judicial convention to address concerns of executive interference in judicial affairs. The judges include Justice Mohsin Akhtar Kiyani, Justice Tariq Mehmood Jahangiri, Justice Babar Sattar, Justice Sardar Ejaz Ishaq Khan, Justice Arbab Muhammad Tahir, and Justice Saman Rafat Imtiaz.

Federal Law Minister Azam Nazeer Tarar, in a press conference following the meeting, affirmed Prime Minister Shehbaz’s commitment to safeguarding the independence of the judiciary. Tarar also disclosed plans to appoint a retired judge of impeccable reputation to supervise the investigation under the Commission of Inquiry Act.

Tarar emphasized the gravity of the judges’ allegations, stressing that no entity should interfere in the affairs of institutions. He assured transparency in the investigation process, dismissing any notion of concealing facts or delaying the probe.

The letter from the IHC judges highlighted the absence of guidance in the code of conduct for judges regarding reporting incidents of intimidation and interference with judicial independence.

Prior to the decision, a full court meeting convened by CJP Isa was held to discuss the judges’ letter, reflecting the seriousness of the matter. Bar associations and senior lawyers across various provinces have also called for an investigation into the letter, underscoring its potential ramifications for the judiciary.

Additionally, a constitutional petition has been filed in the apex court, advocating for an open court investigation into the letter’s contents. Submitted by Mian Dawood Advocate, the petition urges the establishment of an empowered commission to delve into the allegations.

The initiation of a commission probe marks a significant step in addressing concerns raised by the IHC judges and underscores the commitment of the government to uphold the integrity and independence of the judiciary. As investigations unfold, stakeholders anticipate transparency and accountability in uncovering the truth behind the alleged interference in judicial affairs.
